1. Introduction
These Terms of Service (“Terms”) govern your use of the FeelEase mobile application (“App”) developed and operated by FeelEase (“we”, “us”, “our”).
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Definitions
- “App” — the FeelEase mobile application available on the Apple App Store.
- “User” / “you” — any person who downloads, installs, or uses the App.
- “Content” — any text, drawings, journal entries, reflections, or other materials created by the User within the App.
- “Subscription” — a recurring monthly payment that provides access to premium features, including AI companion.
- “Tips” — optional, one-time voluntary contributions to support development of the App.
- “AI Companion” — the optional AI-powered conversational coaching feature available to subscribers.
3. Eligibility
You must be at least 16 years old to use this App.
If you are between 16 and 18 years old, you confirm that you have obtained consent from a parent or legal guardian to use the App, including any AI-powered features.
The App is not intended for persons under 16. If we become aware that a user is under 16, we reserve the right to restrict access to the App.
4. Use of the App
FeelEase does not require account registration. The App operates in guest mode — all data is stored locally on your device.
User Responsibilities
You agree to:
- Use the App solely for personal emotional wellness purposes
- Not use the App for any illegal or harmful purposes
- Not attempt to reverse-engineer, decompile, or exploit the App
- Not use AI features to generate harmful, abusive, or illegal content
5. Health & Wellness Disclaimer
IMPORTANT — PLEASE READ CAREFULLY
FeelEase is a self-care and emotional wellness tool. It is NOT:
- Medical advice, diagnosis, or treatment
- Professional therapy, counseling, or psychiatric care
- A substitute for licensed mental health professionals
- An emergency or crisis intervention service
- A medical device as defined by the FDA (US), EU MDR, or any other regulatory body
The App is intended to support self-reflection and emotional awareness. It does not diagnose, treat, cure, or prevent any medical or psychological condition.
When to Seek Professional Help
Immediately contact a qualified professional or emergency services if you experience:
- Thoughts of self-harm or suicide
- Severe depression, anxiety, or emotional distress
- Psychosis or a mental health crisis
- Any situation requiring urgent medical attention
6. AI Features & Third-Party Data Processing
AI Companion
The App offers an optional AI-powered coaching feature available through a monthly Subscription. By enabling AI features, you acknowledge and agree that:
- Your messages are sent to and processed by a third-party AI service provider
- AI responses are generated automatically and may be inaccurate, incomplete, or inappropriate
- We do not store your AI conversations on our servers — conversation data is processed in real time and stored locally on your device
- The third-party AI provider processes data according to their own policies; see our Privacy Policy for details
- AI responses are generated using third-party AI services. The underlying AI model may change over time to ensure quality and availability
AI Limitations
- AI is NOT a trained therapist, psychologist, or medical professional
- AI responses may be inaccurate, incomplete, or contextually inappropriate
- AI does not replace professional psychological or therapeutic support
- AI is a supportive self-reflection tool, not a substitute for human care
- We do not guarantee the availability, accuracy, or reliability of AI features
7. Subscriptions & Premium Features
The App offers an optional Monthly Subscription that provides access to AI-powered features.
- The Subscription includes up to 400 AI messages per calendar month (UTC)
- The monthly message limit resets on the 1st of each calendar month at 00:00 UTC
- Once the monthly limit is exhausted, AI messaging features will be unavailable until the 1st of the following month
- The monthly message limit is a fair-use policy and may be adjusted at our discretion with prior notice
All features not related to AI companion are available without a Subscription.
8. Billing, Payment & Auto-Renewal
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current billing period
- You can manage or cancel your Subscription at any time in your Apple ID Account Settings
- Any unused portion of a free trial period (if offered) will be forfeited when you purchase a Subscription
Subscription prices and applicable terms are displayed in the App prior to purchase. Prices may vary by region and are subject to change. Any price changes will apply to the next billing cycle following notice.
9. Tips (Voluntary Support)
The App offers optional Tips — voluntary, one-time contributions to support the development of FeelEase.
- Tips are consumable in-app purchases processed through the App Store
- Tips do not unlock features, increase limits, or provide any additional functionality
- Tips are non-refundable, except as required by applicable law or Apple’s refund policies
10. Free Tier & Usage Limitations
FeelEase provides core wellness features at no cost, including:
- Metaphorical card exercises
- Drawing and creative expression tools
- Journaling
- Breathing and grounding exercises
- Mood tracking
- Emergency contacts and crisis resources
The free tier includes a one-time trial of 20 AI messages. This trial is granted once per device installation and is tracked using iOS Keychain storage, which persists across app deletions and reinstalls. Reinstalling the app does not restore the free trial. Once the trial limit is reached, a Subscription is required to continue using AI companion features.
11. User Content & Local Storage
All Content you create in the App (journal entries, drawings, reflections, mood data) is stored exclusively on your device.
- We do not have access to, collect, or store your Content on our servers
- You retain full ownership of all Content you create
- You are solely responsible for backing up your data — we cannot recover Content lost due to device failure, app deletion, or other causes
12. Intellectual Property
Our Content
The App, its design, metaphorical card images, animations, original texts, and all related materials are the intellectual property of FeelEase and are protected by applicable copyright and intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.
Your Content
You retain all rights to Content you create within the App. We do not claim any ownership or license over your Content.
13. Privacy
Your privacy is fundamental to FeelEase. We are committed to the principle of minimal data collection.
- All personal data and Content is stored locally on your device
- We do not collect, transmit, or store personal data on our servers
- When AI features are used, messages are transmitted to a third-party AI provider for real-time processing only

The App may integrate with or contain links to third-party services, including:
- A third-party AI service provider (for AI companion features)
- Apple App Store (for purchases and subscriptions)
- External crisis helpline resources
We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.
16. Disclaimers
The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- AI responses will be accurate, helpful, or appropriate
- The App will meet your specific needs or expectations
- Any defects will be corrected in a timely manner
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- FeelEase, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total aggregate liability for any claims arising from or related to the App shall not exceed the total amount you have paid to us through the App in the twelve (12) months preceding the claim
- We are not liable for any harm resulting from reliance on AI-generated responses
- We are not liable for any failure to seek professional help when needed
- We are not liable for data loss resulting from device failure, app deletion, or operating system changes
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
18. Termination
You may stop using the App at any time by deleting it from your device.
We reserve the right to restrict or terminate access to the App or specific features (including AI services) if:
- You violate these Terms
- You misuse AI features (e.g., generating harmful or abusive content)
- Required by law or a third-party service provider
If your access is terminated, any active Subscription will remain manageable through your Apple ID Account Settings. We are not responsible for charges incurred if you do not cancel your Subscription prior to or after termination.
19. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
For users residing in the European Union or the European Economic Area, nothing in these Terms affects your statutory rights as a consumer under the applicable laws of your country of residence. Any mandatory consumer protection provisions of your local law shall apply.
For users residing in the United States, any disputes shall be resolved in accordance with the laws of the State of Delaware, to the extent not preempted by federal law.

21. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page
- Notify you via an in-app alert where reasonably possible
Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree with any changes, please stop using the App.
22. Apple App Store
The App is distributed through the Apple App Store. You acknowledge that:
- These Terms are between you and FeelEase, not Apple Inc.
- Apple has no obligation to provide maintenance or support for the App
- In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation
- Apple is not responsible for addressing any claims relating to the App or your use of it
- In the event of a third-party intellectual property claim, FeelEase (not Apple) is responsible for investigation, defense, and settlement
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and FeelEase regarding your use of the App.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
