1. Introduction

These Terms of Service (“Terms”) govern your use of the FeelEase mobile application (“App”) developed and operated by FeelEase (“we”, “us”, “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Definitions

• “App” — the FeelEase mobile application available on the Apple App Store.
• “User” / “you” — any person who downloads, installs, or uses the App.
• “Content” — any text, drawings, journal entries, reflections, or other materials created by the User within the App.
• “Subscription” — a recurring monthly payment that provides access to premium AI-powered self-reflection features, including AI Companion, AI Art Companion, Week Review, and Month Review.
• “Tips” — optional, one-time voluntary contributions to support development of the App.
• “AI Companion” — an optional AI-powered conversational self-reflection feature available to subscribers.
• “AI Art Companion” — an optional AI-powered conversational self-reflection feature, available to subscribers, in which your drawing is sent to the third-party AI provider's image-analysis service to guide the conversation. It shares the same message allowance as AI Companion, not a separate limit.
• “Week Review” and “Month Review” — AI-powered summaries generated from eligible saved reflections, mood data, and related activity in Your Journey.
• “My Dynamics” — an optional Subscription feature that shows deterministic, on-device patterns — recurring themes, feelings, and what’s helped — across your saved Week Review and Month Review content, together with a simple count of days you engaged in self-care practices. My Dynamics does not use AI and does not transmit any data to us or to any third party.

3. Eligibility

You must be at least 16 years old to use this App.

If you are between 16 and 18 years old, you confirm that you have obtained consent from a parent or legal guardian to use the App, including any AI-powered features.

The App is not intended for persons under 16. If we become aware that a user is under 16, we reserve the right to restrict access to the App.

4. Use of the App

FeelEase does not require account registration. The App operates in guest mode. Your personal content is stored locally on your device by default; when you choose to use an AI-powered feature, the content that feature needs is sent to our AI service provider, as described in our Privacy Policy.

User Responsibilities

You agree to:

• Use the App solely for personal emotional wellness purposes
• Not use the App for any illegal or harmful purposes
• Not attempt to reverse-engineer, decompile, or exploit the App
• Not use AI features to generate harmful, abusive, or illegal content

Immediately contact a qualified professional or emergency services if you experience:

• Thoughts of self-harm or suicide
• Severe depression, anxiety, or emotional distress
• Psychosis or a mental health crisis
• Any situation requiring urgent medical attention

• AI is NOT a trained therapist, psychologist, or medical professional
• AI responses may be inaccurate, incomplete, or contextually inappropriate
• AI does not replace professional psychological or therapeutic support
• AI is a supportive self-reflection tool, not a substitute for human care
• We do not guarantee the availability, accuracy, or reliability of AI features

7. Subscriptions & Premium Features

The App offers an optional Monthly Subscription that provides access to premium self-reflection features. Most of these (AI Companion, AI Art Companion, Week Review, Month Review) are AI-powered; My Dynamics is a deterministic, non-AI feature also included with an active Subscription.

• The Subscription includes up to 400 AI messages per calendar month (UTC)
• The monthly message limit resets on the 1st of each calendar month at 00:00 UTC
• Once the monthly limit is exhausted, AI messaging features will be unavailable until the 1st of the following month
• The monthly message limit is a fair-use policy. We may change it for future Subscription periods with prior notice; changes will not reduce the benefits already purchased for the current paid Subscription period, except where reasonably necessary for security, abuse prevention, legal compliance, or service integrity
• The Subscription unlocks eligible full Week Review and Month Review features in Your Journey
• Week Review and Month Review require sufficient saved material for the selected period and may not be available if there is not enough eligible data
• The Subscription also unlocks My Dynamics, a non-AI, on-device view of patterns across your saved Week Review and Month Review content; My Dynamics has no free tier or preview and requires an active Subscription

Previously generated Week Review and Month Review content remains readable after a Subscription ends, but generating new premium reviews may require an active Subscription.

8. Billing, Payment & Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period
• You can manage or cancel your Subscription at any time in your Apple ID Account Settings
• Any unused portion of a free trial period (if offered) will be forfeited when you purchase a Subscription

Subscription prices and applicable terms are displayed in the App prior to purchase. Prices may vary by region and are subject to change. Subscription price changes are handled by Apple in accordance with App Store policies and applicable law. Where user consent is required for a price increase, the Subscription will not renew at the increased price unless that consent is provided.

9. Tips (Voluntary Support)

The App offers optional Tips — voluntary, one-time contributions to support the development of FeelEase.

• Tips are consumable in-app purchases processed through the App Store
• Tips do not unlock features, increase limits, or provide any additional functionality
• Tips are non-refundable, except as required by applicable law or Apple’s refund policies

10. Free Tier & Usage Limitations

FeelEase provides core wellness features at no cost, including:

• Metaphorical card exercises
• Drawing and creative expression tools
• Journaling
• Breathing, grounding, and other guided self-help exercises (e.g., Allow the State, Release Anger Safely, Capture This Moment)
• Mood tracking
• Emergency contacts and crisis resources

The free tier includes one-time trial access to 20 AI Companion messages. Trial access is granted once and does not renew after deleting or reinstalling the App. After the limit is used, a Subscription is required for further access to AI Companion.

The free tier includes one successfully generated Week Review at no cost. After this free Week Review has been used, generating future Week Reviews requires a Subscription. Month Review is a premium feature; free users may see only a limited preview when enough eligible material is available.

11. User Content & Local Storage

Your Content (journal entries, drawings, reflections, mood data) is stored locally on your device by default. When you choose to use an AI-powered feature, the content that feature needs is sent to our AI service provider, as described in our Privacy Policy.

• We do not have access to, collect, or store your Content on our servers
• You retain full ownership of all Content you create
• You are solely responsible for backing up your data — we cannot recover Content lost due to device failure, app deletion, or other causes

12. Intellectual Property

Our Content

The App, its design, metaphorical card images, animations, original texts, and all related materials are the intellectual property of FeelEase and are protected by applicable copyright and intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.

Your Content

You retain all rights to Content you create within the App. We do not claim any ownership or license over your Content. When you choose to use an AI-powered feature, you authorize FeelEase and its service providers to process the Content you submit solely as necessary to provide that feature.

13. Privacy

Your privacy is fundamental to FeelEase. We are committed to the principle of minimal data collection.

• Your personal content is stored locally on your device by default
• We do not collect, transmit, or store personal data on our servers
• When AI features are used, relevant content is transmitted to our AI service provider for processing as described in our Privacy Policy

14. Crisis Resources

Crisis resources are provided for informational purposes only. We do not operate, control, or guarantee the availability of these services. FeelEase is not responsible for the actions, advice, or availability of any third-party crisis service.

15. Third-Party Services

The App may integrate with or contain links to third-party services, including:

• A third-party AI service provider (for AI companion features)
• Apple App Store (for purchases and subscriptions)
• External crisis helpline resources

We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

16. Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI responses will be accurate, helpful, or appropriate
• The App will meet your specific needs or expectations
• Any defects will be corrected in a timely manner

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• FeelEase, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total aggregate liability for any claims arising from or related to the App shall not exceed the total amount you have paid to us through the App in the twelve (12) months preceding the claim
• We are not liable for any harm resulting from reliance on AI-generated responses
• We are not liable for any failure to seek professional help when needed
• We are not liable for data loss resulting from device failure, app deletion, or operating system changes

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

18. Termination

You may stop using the App at any time by deleting it from your device.

We reserve the right to restrict or terminate access to the App or specific features (including AI services) if:

• You violate these Terms
• You misuse AI features (e.g., generating harmful or abusive content)
• Required by law or a third-party service provider

If your access is terminated, any active Subscription remains managed through Apple and your Apple ID Account Settings; cancellation, refunds, and billing during or after a suspension or termination are governed by Apple's policies and applicable law.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

For users residing in the European Union or the European Economic Area, nothing in these Terms affects your statutory rights as a consumer under the applicable laws of your country of residence. Any mandatory consumer protection provisions of your local law shall apply.

We encourage you to contact us first at contact@feelease.app to resolve any issues informally.

For EU residents: You may have access to applicable national or cross-border alternative dispute resolution (ADR) mechanisms.

21. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the “Last Updated” date at the top of this page
• Notify you via an in-app alert where reasonably possible

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree with any changes, please stop using the App.

22. Apple App Store

The App is distributed through the Apple App Store. You acknowledge that:

• These Terms are between you and FeelEase, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation
• Apple is not responsible for addressing any claims relating to the App or your use of it
• In the event of a third-party intellectual property claim, FeelEase (not Apple) is responsible for investigation, defense, and settlement
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and FeelEase regarding your use of the App.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
